GENERAL TERMS AND CONDITIONS OF BUSINESS
Scope
a) These general terms and conditions apply to all orders placed by customers via the online shop of swiss beauty+med.01 gmbh swiss-harmony.ch/kosmetik-online-shop, Speichergasse 37, 3011 Bern, Switzerland, CHE-447.669.164, hereinafter referred to as Swiss Harmony Cosmetics.
b) With the confirmed order, these general terms and conditions are deemed to be accepted by the customer.
Offer and conclusion of contract
a) The presentation of the products in the online shop does not constitute a legally binding offer, but rather an invitation to order.
b) By clicking the button (Order), the customer places a binding order for all products listed on the order page.
c) Immediately after receiving the order, Swiss Harmony confirms Cosmetics accepts orders via email. The purchase contract is concluded immediately for non-physical goods and upon delivery for physical goods.
Prices and shipping costs
a) The prices listed on the product page include VAT and other price components (postage, packaging) and are in Swiss francs (CHF). The exact shipping costs will be displayed to the customer during the ordering process. They are as follows:
- PostPac Economy : Delivery in 2-3 working days – For free
- PostPac Priority : Delivery on the next working day (if the order is placed before 5:00 PM) – CHF 8.50
- However, for ecological and administrative reasons, we charge a Small quantity surcharge of CHF 10.– for orders under CHF 50.– .
b) There are no further taxes or costs.
c) The provider reserves the right to change prices at any time. The prices published on the website on the date of the order apply to customers.
Delivery conditions
a) The delivery of physical goods takes place within Switzerland.
b) The delivery time is, unless otherwise stated in the offer:
- PostPac Economy: 2-3 working days
- PostPac Priority: Delivery on the next working day (if the order is placed before 5:00 PM)
If a longer delivery period is necessary, the customer will be informed at the latest after this period has elapsed. If no notification is provided, the customer is entitled to forgo delivery.
c) If not all ordered products are in stock, Swiss Harmony Cosmetics is entitled to make partial deliveries.
d) Should the delivery of the goods fail due to the customer’s fault despite three delivery attempts, Swiss Harmony Cosmetics may withdraw from the contract. Any payments made will be refunded immediately.
Payment terms
a) Customers in Switzerland can pay using TWINT, prepayment, invoice (MF Group/PowerPay), Visa, Mastercard®, American Express, JCB, China UnionPay, or debit cards. You enter your card details during the order process via a secure connection (SSL) in our online shop, and we transmit your data in encrypted form directly to our payment provider ( Stripe). or PayPal ). For security reasons, we do not store your credit card information. Your credit card will not be charged until the order process is completed. We will process your order immediately.
b) Set-off against counterclaims of the customer that are not recognised or have not been legally established is excluded.
c) The customer may only exercise a right of retention if the claims are based on the same contractual relationship.
Purchase on account with installment option (POWERPAY)
MF Group / POWERPAY, as an external payment service provider, offers the payment method "purchase on account." With this single invoice, you can easily pay for your online purchase by invoice. If you fail to pay within the specified timeframe, you will receive a monthly invoice with an order overview in the following month.
Upon conclusion of the purchase agreement, POWERPAY assumes the resulting invoice amount and handles the corresponding payment terms. When purchasing on account, you accept POWERPAY's terms and conditions (powerpay.ch/de/agb) in addition to ours.
Retention of title
The goods remain the property of Swiss Harmony until full payment Cosmetics. Prior to transfer of ownership, pledging, transfer by way of security, processing, or modification is not permitted without the consent of swiss beauty+med.01 gmbh.
Right of withdrawal
a) Consumers have the right to withdraw from the contract within 14 days of receiving the goods. The withdrawal is Swiss Harmony Cosmetics in writing by email or letter. The time of sending the cancellation is decisive for compliance with the deadline. A reason for the cancellation is not required. The cancellation notice should be sent to:

Unfortunately, we cannot offer returns in the following cases:
- For damaged items (except transport damage)
- If the original packaging is not available or the product is no longer in its original, possibly sealed, packaging.
- The product has been opened/used.
b) Exercising the right of withdrawal will convert the purchase contract into a rescission agreement, according to which the services received under the purchase contract must be refunded. The consumer must return the received goods, including the original packaging, to swiss beauty+med.01 gmbh within 14 days of declaring the withdrawal. The consumer shall bear the return shipping costs.
c) Upon receipt of the goods, the purchase price, if already paid, will be refunded to the consumer immediately. A deduction from the refundable purchase price for possible damage or excessive wear and tear remains reserved. No deduction will be made if the loss in value is due to handling of the goods necessary to determine their nature, quality, and functionality. swiss beauty+med.01 gmbh may refuse reimbursement until the goods have been returned or until the consumer has provided proof of having returned the goods, whichever is earlier.
Warranty and liability
a) Swiss Harmony Cosmetics warrants that the goods conform to the warranted characteristics, have no defects that impair their value or suitability for the intended use, and comply with the prescribed performance and specifications. Rebellion group ag reserves the right to remedy an existing defect or to deliver a defect-free item by way of repair or replacement.
b) The buyer must inspect the delivered goods as quickly as possible and report any defects immediately. You can contact our customer service at info@swiss-harmony.ch.
c) If repair or replacement fails, the customer is entitled to withdraw from the contract. This does not apply to minor defects. The customer's right to a price reduction is excluded.
Passwords / Confidentiality
For products made available online, the customer undertakes to treat the system access data and passwords provided as strictly confidential and with the utmost care. Swiss Harmony Cosmetics reserves the right to immediately terminate the user authorization if it discovers multiple use of access data by an authorized individual.
Copyright
The content and structure of the products published by swiss beauty+med.01 gmbh and the entire website are protected by copyright. The use of articles and tools for the customer's own personal use is permitted; however, any commercial distribution, in whole or in part, requires the express consent of Swiss Harmony. Cosmetics.
Liability
Swiss Harmony Cosmetics excludes liability for slightly negligent breaches of contract. The same applies to breaches of contract by auxiliary persons and substitutes. swiss beauty+med.01 gmbh assumes no liability for errors that are not within its area of responsibility, namely those of telecommunications service providers, the hosting provider, or other third-party service providers.
Place of jurisdiction and applicable law
The contractual relationship between the customer and swiss beauty+med.01 gmbh (Swiss Harmony Cosmetics) are subject to Swiss substantive law, excluding the United Nations Convention on Contracts for the International Sale of Goods of 11 April 1980. Any disputes arising from these contractual relationships shall be subject to the jurisdiction of the ordinary courts in Zurich.
Final provisions
Should any part of these General Terms and Conditions be invalid, this shall not affect the validity of the remaining provisions. The invalid provisions shall be replaced by the relevant statutory provisions.
